Terms of Service

1. Acceptance of Terms

By installing and using the eTrack application ("the Service") via the Shopify App Store, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall the Service immediately.

The Service is owned and operated by WIRESELLS SRL, a limited liability company registered in Romania ("we", "us", "our").

2. Description of Service

eTrack is a Shopify App designed to automate logistics and financial operations. The Service allows merchants to:

• Generate shipping labels (AWBs) by connecting with third-party couriers.
• Sync order tracking status to Shopify in real-time.
• Automate invoice generation via third-party billing platforms.
• Display locker selection widgets (e.g., Easybox) at checkout.

3. Account and Usage Requirements

To use the Service, you must:

• Have a valid, active Shopify store.
• Be at least 18 years of age or the age of majority in your jurisdiction.
• Provide accurate courier and billing API credentials (e.g., Sameday username, SmartBill token) within the App settings.

You are responsible for maintaining the security of your Shopify account and API keys. WIRESELLS SRL cannot be held liable for any loss or damage arising from your failure to secure your account credentials.

4. Third-Party Integrations & Disclaimer

eTrack acts as an aggregator and technical bridge between your Shopify store and external third-party services, including but not limited to:

Couriers: Sameday, Cargus, Geniki Taxydromiki, Meest, GLS, Fan Courier, Packeta.

Invoicing Platforms: SmartBill, Oblio.

5. Billing and Payments

Subscription Fees: Usage of eTrack is subject to the recurring fees or usage-based charges displayed on our Shopify App Store listing.

Billing Method: All billing is handled directly by Shopify's Billing API. eTrack does not store or process your credit card information.

Refunds: We adhere to Shopify's refund policies. As a general rule, subscriptions are non-refundable except where required by law. Uninstallation of the app stops future billing cycles but does not automatically refund the current cycle.

6. Intellectual Property

All rights, title, and interest in the eTrack application, including its source code, design, algorithms, and documentation, remain the exclusive property of WIRESELLS SRL.

You are granted a limited, non-exclusive, non-transferable license to use the App solely for your Shopify store operations.

Restrictions: You may not reverse engineer, decompile, or attempt to extract the source code of the App. You may not resell or white-label the Service without our express written consent.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, store, and process your data (including hosting on Hetzner servers in Germany). By using eTrack, you consent to such processing.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

"AS IS" Basis: The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

No Consequential Damages: WIRESELLS SRL shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, shipping delays, or business interruption, arising from your use of the Service.

Liability Cap: In no event shall our total liability to you exceed the amount you paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim.

9. Termination

By You: You may terminate these Terms at any time by uninstalling the eTrack application from your Shopify store.

By Us: We reserve the right to suspend or terminate your access to the Service immediately, without notice, if you violate these Terms (e.g., attempting to hack the API, fraudulent usage).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Brasov, Romania.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via the App dashboard or email. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
